European IA law: artificial intelligence and data governance

In June 2023, the EU presented a proposal for a law on Artificial Intelligence (AI), the first law in the world to regulate its use. The European Commission defines this term as "the ability of a machine to mimic some of the characteristics of human intelligence, such as learning, reasoning or creativity". Discussions are currently underway with member countries in the Council to finalize the legislation, with the goal of reaching an agreement before the end of the year.

The concept of AI is not new, although the recent popularisation of generative AIs such as Chat GPT has opened a debate about the use of personal data or misinformation, in this sense and from the perspective of data sharing, data security and management has become an essential component in today's business world, where AI has emerged as a revolutionary and tremendously useful technology.

The objective behind this regulation is to ensure better conditions for its development and use, as it can bring both benefits and risks in data management, for example, in the detection and prevention of cyber threats or in manufacturing efficiency, among others. This proposed law therefore aims to establish different rules for different levels of risk: unacceptable, high, limited and minimal, so as to provide companies and users with the legal certainty they need to innovate. It seeks to establish a uniform and technologically neutral definition of AI, applicable to future AI systems.

Secondly, high-risk AI systems will be under close scrutiny, but are not considered dangerous enough to be banned; thirdly, those categorised as limited risk must meet minimum transparency requirements, for example, reporting when interacting with an AI; and finally, there are those of minimal risk, which include applications such as spam filters or AI-enabled video games. The Commission proposes that these be regulated mainly through voluntary codes of conduct.

Ultimately, AI is optimising data management and generating significant impacts on businesses and society at large. Although it presents challenges, the potential of AI in data management is undeniable, and with an ethical approach and a thorough study of its applications, this technology can be a great ally in the management of information in the digital era.
